Mr. Cain's practice focuses on civil litigation
with an emphasis on cases involving personal injury. His experience in
personal injury defense litigation includes not only general bodily
injury but also the handling of complex claims alleging brain injury,
cognitive deficit, spinal injury and other injuries to the nervous
system.
He has also considerable experience representing insurance companies
in cases involving claims of "bad faith" conduct against insurers,
including actions based on UM/UIM coverage [See published opinions of State Farm Mutual Automobile Insurance Co. v. Kastner, 77 P.3d 1256 (Colo. 2003)], the Colorado No-Fault
("PIP") Statute, and other claims of "insurer misconduct". Salazar v. State Farm Mutual Automobile Insurance Co., 148 P.3d 278 (Colo. App., 2006); Trigg v. State Farm Mutual Automobile Insurance Co., 129 P.3d 1099 (Colo. App., 2005). He is very
experienced in the drafting of opinion letters concerning a wide
variety of insurance and insurance coverage issues.
Mr. Cain is also experienced in the defense of construction defect claims
concerning both residential and commercial properties. He has also
represented the State of Colorado in a claim against the Department of
Corrections and the Department of Transportation, as well as
representing a number of municipalities. His experience additionally
includes handling litigation involving significant property loss due to
fire. The defense of trucking claims has also been a focus of Mr.
Cain's practice.
His considerable civil defense
experience and significant prior service as a Deputy District Attorney
for the Fourth Judicial District has provided Mr. Cain a considerable
background in the litigation and prosecution of both civil and criminal
matters. Consequently, Mr. Cain's courtroom experience is extensive.
Mr. Cain is a member of various State and
Federal associations such as the American Bar Association, Colorado and
El Paso County Bar Association, the Faculty of Federal Advocates, the
Colorado Defense Lawyers Association where he also served as co-chairman from 1993-1995/2003-2005, and the Defense Research Institute.
